Which one is the legal document?

Masinalupe Tusipa.The Ministry of Justice, Courts and Administration, Chief Executive Officer, Masinalupe Tusipa Masinalupe yesterday denied forging a signature of District Court Judge, Tafaoimalo Leilani Tuala – Warren, in an adoption document.

“I printed the Judge’s name to assist the (adopted) family," Masinalupe explained yestetday during an interview with the Samoa Observer.

There are two Orders of Adoption documents dated on the 12 day November 2014, one has the name of the Judge “printed” on it as claimed by Masinalupe, and the other is signed by judge. (see copies of documents below.)

Masinalupe insisted; “I did not do anything wrong.

“The Court granted the adoption.

“I know what people think that I forged the adoption but the adoption was granted by the Judge. “I did not do anything wrong. The adoption was granted and we assisted the family to get the birth certificate because the Judge had gone overseas for medical treatment.”

Masinalupe explained: “I did not forge it (her signature).

“What I did was print the judge’s name so that the family can get the birth certificate because the adoption was already granted.”

He added: “The whole purpose of it was to assist, in order for the Birth Certificate office to allow them to do the birth certificate.”

The documents published above were fi led in the District Court. They are but one document except for the two different signatures which has raised concern as to which one of the two is the legal one.Asked if the Judge was aware of what he had done, Masinalupe said; “Yes. It is not new. It is not unusual (to do this) when an adoption is granted.

“It would be illegal for me to do it without the adoption being granted. That is why I did it and gave it to the office to show that the judge had granted it".

“The judge was overseas at the time for medical treatment.”
