The application to withdraw the charge was made by prosecution lawyer, Rexona Titi, of the Attorney General’s Office, when the matter was mentioned before Chief Justice, His Honour Patu Tiava’asu’e Falefatu Sapolu. Ms. Titi did not give reasons for her application to the Court.
But she also asked that the hearing of the indecent assault charge remaining against Tupuola be transferred to the District Court.
Chief Justice Patu granted both applications.v As a result, the attempted rape charge was dismissed. He also adjourned the matter until today where it will be heard in the District Court.
Tupuola initially faced two charges; one of attempted rape and indecent assault.
