Date set for hearing of lawsuit against Speaker

AT COURT: Associate MInister, Peseta Vaifou Tevaga, outside the Supreme Court.The hearing of an injunction in a civil claim against the Speaker of Parliament, La’auli Leuatea Polata’ivao, and other respondents, has been set for next month.

The claim is brought by the Associate Minister for the Ministry of the Prime Minister, Peseta Vaifou Tevaga, who has also filed for criminal charges against the other party.

In the Supreme Court yesterday, Justice Lesatele Rapi Va’ai adjourned the proceedings until 11 December 2015.

Lawyer, Leulua’iali’i Olinda Woodroffe, is representing Peseta while Alalatoa Rosella Papali’i appeared on behalf of Semi Leung Wai, who is representing the Speaker.

The other respondents are Apulu Lance Pulu, Martin Jonathan Schwalger, Local Partners and Associates Limited and Maota o Samoa Convention & Leisure Complex Limited.

Leulua’iali’i yesterday told the Court that the matter is quite serious.

It involves Local Partners and Associates, which exports nonu juice.

She said Peseta owns 50percent shares of the company.

She told the Court that her client has also filed criminal charges.

“We subsequently found out that the nonu juice had been sent out and payments for money have been made under a different company were taken by people that weren’t even part of the company,” said Leulua’iali’i.

“In that respect, there is now a formal complaint by my client on a criminal matter…there is also a complaint against my client by the other side alleging that he forged a signature.”

In asking the Court for a hearing date, Leulua’iali’i said the matter is very sensitive. “The application for injunction was filed and this Court decided it was an ex-parte application to also serve the other parties that which now they all received the documents,” she said.

“I’m urging the Court for an urgent date to hear the injunction because there is a likelihood of violence against my client."

“I even got locked out when I went to try and inspect the property last Friday and the matter is in the hands of police.”

The injunction hearing will be heard on 11 December 2015.
